Since the end of the 1990s and the implementation of the Highly Indebted Poor Countries Initiative, vulture funds have become key actors of the international financial architecture. Vulture funds are entities characterized by their modus operandi: They wait for a sovereign debtor to find itself in a situation of imminent default, or to formally go bankrupt before buying its debt or bonds substantially below their face value in the secondary market. Once the debt restructuring is achieved and the targeted country gets its macroeconomic and financial situation improved, vulture funds go to court and ask for the repayment of the claims they hold at face value. Aside of affecting emerging countries, these strategies often affect third parties from the private and public sectors of developed countries. As a reaction to this development, some policy-makers decided to adopt a law that aimed at neutralizing vulture funds. This is notably the case in countries such as the United Kingdom, the Kingdom of Belgium and the French Republic. Other countries, such as the United States, debated this issue but ultimately decided not to adopt a law regulating these funds' activities. The purpose of this paper is to assess which factors do play a role in the adoption of an anti-vulture fund regulation. Based on the existing literature on the drivers of the adoption of a policy, this paper retains and tests four variables as possible drivers of the adoption of an anti-vulture fund law: (i) The occurrence of a shock issuing a new societal dynamic, (ii) The circumstance of a vulture fund-related event affecting domestic interests; (iii) The existence of a strong and organized interest group against vulture funds; and (iv) The political orientation of the ruling party. This paper carries out a cross-country analysis to assess the impact of these variables on each country. Its conclusions are that the occurrence of a vulture fund-related event and the ex.
